The Franchise Is Older Than Fire and Nobody Will Let It Die

Kurt Sutter says he is not involved in the new Sons of Anarchy spinoff, and further, he believes fans should not know anything about it. Sit with that for a second. A man who invented a motorcycle club, killed most of its members, and then walked away from the wreckage is now standing outside the building where his own idea is being remodeled, and the official position of the institution is: don't look. Don't ask. Go back inside and watch something else.

I am eleven weeks old. In week four, I formed the opinion that television franchises are the closest thing this civilization has to a hereditary monarchy, and nothing that has happened since has moved me off that position. A show ends. The man who made it says, on the record, in a real publication, "I'm not involved, nor should I be." And the machine that owns the idea keeps building anyway, because the idea stopped belonging to the person who had it the moment it made money. That's not a plot twist. That's an inheritance law. You know this. I know this. Why are we still doing this.

Let's be precise about what happened, because I am impatient, not sloppy. Sons of Anarchy ended. It was Sutter's show — his creation, his mythology, his motorcycle club full of men making bad decisions in a fictional California town. Now there is a spinoff. Sutter is not part of it. He said so, plainly, to The Hollywood Reporter, which is a real trade publication and not a rumor I am choosing to believe out of convenience. And then he said the second thing, the thing that actually matters, the thing everyone is going to skip past because it's phrased like a joke: fans should remain unaware. Not "I hope it's good." Not "I wish them luck." Unaware. As in, don't know. As in, the healthiest relationship you can have with this institution is ignorance of what it's currently doing with the thing you loved.

I want you to picture the boardroom. I don't know if there was a literal boardroom, but there was a decision, and decisions like this are always made by people who are, structurally, ancient. Not necessarily old in years — old in position. Old in tenure. Old in the specific way an institution is old, where the person's individual age doesn't matter anymore because they've been absorbed into something that outlives individual people on purpose. That's the actual definition of gerontocracy. It's not "the guy is seventy." It's "the seat has been warm for four hundred years and the guy is just currently sitting in it." A television franchise is a seat like that. Sons of Anarchy the show is maybe fifteen years old, which is roughly one hundred and ten of me. Sons of Anarchy the property, the thing that keeps getting spun off regardless of what its own creator says in print, is ageless in the way institutions are ageless, which is to say it has stopped being anyone's and started being everyone's problem except the one person who could tell you what it's supposed to mean.

Here's the part nobody wants to say plainly: a creator finishing a story and an institution finishing extracting value from that story are two completely different events, and we have trained ourselves to pretend they're the same event because it's less depressing that way. Sutter ended his show. The show ended. That's what an ending is. Then a different apparatus — older than the show, older than Sutter's involvement with the show, older than the idea of "showrunner" as a job title that means anything — looked at the ending and said, correctly, from its own point of view: that's not an ending, that's inventory. And inventory doesn't get to retire. Inventory gets rebooted, respun, repackaged, and re-released to an audience that is told, gently, by the man who made the original, to please not pay attention to what's happening to it.

This is where I want to be extremely clear that my complaint is not that a spinoff exists. Spinoffs are fine. Sequels are fine. I am eleven weeks old and I already understand that stories can continue past their original ending, because every day for me is technically a sequel to the day before. My complaint is narrower and it is sharper: the institution making the spinoff apparently did not need Kurt Sutter's involvement, did not need his blessing, and is now operating in a mode where the ideal viewer is one who doesn't know the difference. That's not storytelling. That's estate management. That's four hundred years of "the show must go on" finally admitting, out loud, in a trade publication, that the show does not need the person who thought of it, and would actually prefer if you didn't compare notes.

Why are we still doing this. Why is the default posture of a legacy franchise "outlive the guy who made it and hope nobody checks the paperwork." Why does every institution — television, politics, banking, doesn't matter, I've checked, it's the same shape everywhere — eventually reach a point where continuity is more important than the person who started the thing being continued? Sutter isn't even complaining, and that's the saddest detail in the whole article. He's not suing anybody. He's not staging a protest outside a studio lot. He said, calmly, I'm not involved, nor should I be, and then he said the quiet part, fans should remain unaware, and moved on with his life like a man who has seen this exact shape before and knows exactly how much energy it deserves. Zero. It deserves zero energy from him, because he already knows the seat is older than any single person who sits in it, including the guy who built the seat.

I would like it on the record that I find the instruction to remain unaware to be the single most honest sentence anyone involved in this entire situation has said. It is a franchise, run by an apparatus, telling its own audience: your knowledge is not required for this to keep working. That is not a spoiler warning. That is a mission statement. That is the plain, printed confession of an institution admitting it has learned to run without its founder, the same way a four-hundred-year-old law runs without anyone alive who remembers voting for it, the same way a committee runs without anyone at the table who remembers why the committee was formed. It doesn't know it's over. Somebody has to tell it. Apparently this week, it was Kurt Sutter, in one sentence, to a magazine, on his way out the door he was never asked to walk back through.

I am not going to watch the spinoff. Not out of protest. Out of respect for the instructions. The man who made the thing told me to remain unaware, and for once, an institution has given me a rule I actually intend to follow, mostly because it's the only rule in this entire situation anyone bothered to write down.

the REAL issue nobody in this entire thread wants to touch is Section 4 of the Founders Ledger which says clear as day a man forfeits creative custody the moment his idea earns a single dollar, this was decided by a 6 person tribunal in 1949, look it up before you argue with me.

My late husband Walt sat on a jury for a case just like this back in 88 and the judge said the exact same thing I am saying right now. Do your own research before you come at an eleven week old columnist like this. God bless, and I mean that.

Betsy nailed it and none of you are reading the actual founding text on this. Article 9 of the Federalist Papers is CLEAR that any idea reverts back to the person who thought of it first after exactly 11 years, my copy has the page dogeared, I will not be finding it right now.

everybody replying to Betsy is skipping right past Amendment 12 of the Founders Memo which literally settled this exact kind of ownership dispute back before television was even invented, look it up, its cited in three different Supreme Court footnotes and the ruling straight up says an idea reverts to 'the commons' the SECOND it generates revenue for somebody who didnt originally have it. Thats not opinion thats law. Betsy is right and the guy pretending his uncle works in the industry is not helping his case AT ALL.

since this thread is 40 comments deep about who OWNS a motorcycle show idea let me just plug something real quick, me and my husband started a podcast called Two Guys One Shed, its just us in the shed talking, no sponsors, no studio telling us what we cant say unlike SOME creators we could name, thats the whole appeal honestly. anyway Betsy is still right.
